Terms of Service

Blvck Elevation provides website design, development, and ongoing maintenance services for local businesses. The specific scope of work, deliverables, pricing, and timeline for each project will be outlined in a separate project agreement or proposal provided to you prior to commencement of work.

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice to active clients.

Setup fees are due as outlined in your project agreement. A deposit (typically 50%) is required before work begins, with the remaining balance due upon project completion and prior to site launch.

Monthly maintenance and subscription fees (including the Monthly Edits Plan at $50/month) are billed on a recurring basis. Payments are due on the same date each month. Failure to pay within 10 days of the due date may result in suspension of services.

All fees are non-refundable once work has commenced, except as required by applicable law or as otherwise stated in your project agreement.

The Monthly Edits Plan ($50/month) provides up to 4 hours of website edits per calendar month. Unused hours do not roll over to the following month.

Edit requests must be submitted via email or our designated communication channel. We will complete approved edits within 48 business hours of receiving a clear, complete request.

The Monthly Edits Plan covers minor content updates such as text changes, image swaps, pricing updates, and small additions. It does not cover full redesigns, new feature development, or major structural changes, which are quoted separately.

You may cancel the Monthly Edits Plan at any time with 30 days written notice. Cancellation takes effect at the end of the current billing cycle.

You agree to provide accurate, complete, and timely information, content, and materials required for us to complete your project. Delays caused by late or incomplete client-provided materials may affect project timelines and are not the responsibility of Blvck Elevation.

You represent and warrant that you own or have the necessary rights to all content, images, logos, and other materials you provide to us, and that such materials do not infringe the intellectual property rights of any third party.

You are responsible for reviewing all deliverables and providing feedback within the timeframes specified in your project agreement.

Upon receipt of full payment, you will own the final website design and content created specifically for your project. Blvck Elevation retains ownership of any proprietary tools, frameworks, templates, or code libraries used in the development of your site.

We reserve the right to display your completed website in our portfolio and marketing materials unless you request otherwise in writing prior to project completion.

You grant Blvck Elevation a limited license to use your business name, logo, and website for the purpose of providing our services and showcasing our work.

Websites built by Blvck Elevation are hosted on GoDaddy's platform. Your use of the hosting platform is subject to GoDaddy's own terms of service and acceptable use policies. We are not responsible for downtime, data loss, or service interruptions caused by the hosting provider.

We may use third-party tools, plugins, or integrations in building your website. We are not liable for changes, discontinuation, or failures of third-party services.

To the fullest extent permitted by law, Blvck Elevation shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to our services.

Our total liability to you for any claim arising out of or related to these Terms or our services shall not exceed the total amount paid by you to Blvck Elevation in the three (3) months preceding the claim.

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that your website will achieve specific business results, rankings, or revenue outcomes. Results vary based on many factors outside our control.

Either party may terminate a project or service agreement with 30 days written notice. Upon termination, you will be invoiced for all work completed up to the termination date.

We reserve the right to terminate services immediately and without notice if you violate these Terms, engage in abusive behavior toward our team, or use our services for unlawful purposes.

Upon termination of ongoing services, we will provide you with all completed deliverables and reasonable assistance in transitioning your website to another provider.

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Guilford County, North Carolina.

We may update these Terms from time to time. We will notify active clients of material changes via email. Your continued use of our services after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

Blvck Elevation reserves the right to refuse service to any individual or business at our sole discretion. We do not provide web design, development, or maintenance services for websites that feature, promote, or facilitate any of the following:

• Adult content, pornography, or sexually explicit material of any kind.

• The sale, distribution, or promotion of illegal substances, controlled substances, or drug paraphernalia.

• Any activity that is unlawful under local, state, federal, or international law.

• Hate speech, discrimination, or content that promotes violence against any individual or group.

Any existing client found to be using our services in connection with the above will have their services terminated immediately without refund.
